How to Use This Tool

  1. Choose how the decision was sentBy email or ImmiAccount, by hand, by post within Australia, or by post to an address outside Australia.
  2. Enter the dateThe date the email was sent, the decision was handed to you, or the date printed on the letter.
  3. Say whether you were in detentionThe limit is 14 days instead of 28 if you were in immigration detention when notified.
  4. Read your deadlineThe panel shows the date you are taken to be notified, the time limit and your last day to apply.
  5. Lodge earlyApply and pay the fee well before the deadline. Late applications cannot be accepted.

Frequently Asked Questions

Plain-English answers to the questions we are asked most often.

How long do I have to appeal a visa refusal to the ART?

For most refusal and cancellation decisions, you must apply to the Administrative Review Tribunal within 28 days after you are notified of the decision. If you were in immigration detention when notified, the limit is 14 days.

Can the ART extend the time limit?

No. For migration and protection decisions the Tribunal has no power to extend the time. If you apply late, the Tribunal cannot review your decision.

When am I taken to be notified of the decision?

It depends on how it was sent. Email or ImmiAccount: at the end of the day it was sent. By hand: when it was handed to you. By post within Australia: 7 working days after the date of the letter. By post to or from overseas: 21 days after the date of the letter.

What is the ART application fee?

The application fee for most migration decisions is AUD 3,727. You can ask for a 50% reduction if paying would cause severe financial hardship, and half the fee is refunded if the review is decided in your favour. The fee must be paid by the deadline.

What about character (section 501) decisions?

Refusals or cancellations on character grounds under section 501 have a much shorter time limit of 9 days, and this calculator does not cover them. Decisions made personally by the Minister cannot be reviewed by the ART. Get advice immediately.

Is my decision reviewable at all?

Your decision letter tells you whether the decision can be reviewed, who can apply and the time limit. Many refusals of applications made outside Australia cannot be reviewed. Always follow the deadline in your letter if it differs from this calculator.

Why is this deadline described as conservative?

The calculator skips weekends for post within Australia but does not count public holidays, which can only make the real deadline later. Lodging by the date shown keeps you on the safe side.

What if the deadline has passed?

The ART cannot accept a late application, but other options may exist, such as a new visa application or a request for ministerial intervention. Contact a Registered Migration Agent straight away.
